Is Spain legally prepared to address climate change?

How do human rights relate to the climate crisis? What mechanisms does the Spanish legal system have in place for the defence of the climate?

Spain has a legal framework that includes climate rights and offers legal mechanisms for climate protection, but it needs to be applied “correctly” by both the public and private sectors, according to a report by the International Institute of Law and Environment (IIDMA).

The document, entitled Climate Rights. Legal mechanisms for the defence of climate in Spain and presented on Monday at the Carlos III University of Madrid, analyses the development and evolution of climate rights by identifying a series of litigations whose legal argumentation has been based on these rights, together with a review of the legal tools that offer mechanisms for the defence of the climate.
