The Official State Gazette (BOE) of this Thursday echoes the resolution of December 4 of the General Secretariat of Territorial Coordination, which publishes the agreement of the bilateral Commission between the State and the Balearic Islands on Law 10/2019, of February 22, on climate change and energy transition of the Balearic Islands. In this agreement, both parties agree to consider “the disputes concluded”.
As stated in the BOE, which officially puts the agreement in writing, both parties “agree to consider” that the third additional provision, in relation to article 67 of this regional law –the one that deals with the limitation of the circulation of diesel vehicles– refers to an issue, in accordance with judgment 87/2019, of 20 June, “reserved to the exclusive competences” of the State.
For this reason, the agreement states that the autonomous community “undertakes to suspend” the calendar provided for in said provision, in accordance with the authorization established in the fifth section of the third additional provision of Law 10/2019, while the State “establishes the corresponding regulation taking into account the unique circumstances of the insular event”.
Specifically, the third additional provision determines that, as of January 1, 2025, the circulation of motorcycles and passenger cars that run on diesel is prohibited.
It also sets January 1, 2035 as the date of prohibition for the circulation of motorcycles, cars, vans and vans that are not emission-free. Except, in both cases, for those vehicles to which exceptions apply for reasons of public service or which, previously, are already in circulation and registered in the Balearic Islands.
It should be remembered that the central government and the regional executive reached this agreement at the end of last month, thus preventing the regional regulations from reaching the Constitutional Court.
In the article of the BOE published this Thursday it is also stated that both the Balearic Islands and the State consider that articles 1.2, 14.2, 20.1 and 23 of the regional regulations “do not raise any competition controversy” since the Law refers as a whole to the respect and applicability of the basic state legislation “.
It is also considered that article 68.3 of Law 10/2019 “will be interpreted in the terms established in the basic state legislation”.
