The Government has opened a prior public consultation to modify the regulatory framework that regulates the Energy Savings Certificates (EAC) system, with the aim of improving its management after two years of implementation and progressive adaptation. The initiative affects Royal Decree 36/2023, of 24 January, which establishes the CAE system, and Order TED/815/2023, of 18 July, which partially develops it, and seeks to introduce adjustments that strengthen its operation and sustainability in line with European regulations on energy efficiency. The regulatory revision responds directly to the approval of Directive (EU) 2023/1791 on energy efficiency, published on 20 September 2023, which culminated a long legislative process initiated in 2021 within the European “Fit for 55” package. This directive reinforces the final energy saving objectives and obliges Member States to adapt their national instruments, including the National System of Energy Efficiency Obligations, within which the EAC system is developed.
